Hi all,

I bought a card from a US seller in mid July and it still haven't arrived.  I talked to the seller in mid August and they said that they had put a tracer on it and that the PO would contact them in a few days.  When I contacted them again recently, they never replied.

I did contact them once in September and they said the PO still haven't contacted them back yet.

Unfortunately it's wayyy past PayPal's 45 day deadline for filing claims and such, so I was wondering if anyone could give me any advice on what I can do?

I'm guessing it's lost.  Is there any way to get compensation from the PO?  (it's international mail and worths around 85USD)

Any advice would be much appreciated!

I sold to a buyer in France in early August, and the cards have not made it to them either. Also, past the 45 days, but I do not want to risk negative feedback AND I know how much it sucks to not get something yiu are expecting. I would want my money back, which is exactly what I plan to do for the buyer. I asked them to give it one more week, and if it still does not arrive, I am giving a full refund. I think you should try to ask for one and see what happens. Otherwise, leave a negative feedback.

Unless the seller purchased postal insurance, there is no way to get your money back from the post office.  You should tell the seller that the item still has not arrived and you want a refund.  Since the 45-day PayPal deadline has passed, you're pretty much at his or her mercy in terms of a refund.  Do you know what method of shipment was used?  I've found First Class International to be fairly unreliable.

Unfortunately, it has been past the feedback date as well.

And yes, it was first class int'l with no insurance.  :'(

I'm thinking of directly filing a chargeback with my credit card company.  Should I do this?

Ask for a refund first, if they do not do anything/respond, then file a chargeback.

As long as you have the item number, you should be able to leave feedback up to 90 days after the transaction.  If you go into the listing, is there a button to click to leave feedback?  A chargeback is probably your only option at this point.

Thanks for your advice all.

I'll going to the bank soon and file one.  The seller finally replied but they refused to take responsiblity for it, even though they said that they put a tracer on it and the PO said that it'll be going back to them.  They originally told me that they'll inform me if the PO gets back to them on the tracer but I didn't know until now.

Does PayPal or the credit card company usually win chargebacks? Huh

The seller doesn't have an option.  PayPal and eBay require that the item be delivered.  If you didn't receive it and the seller can't prove you received it (via tracking), then you are entitled to a full refund.  I've never heard of a credit card company not allowing a chargeback for non-receipt of goods, probably because if the seller can't provide proof of delivery, then it's possible he or she never shipped the item at all.  Just remember that you can file either with the credit card company or with PayPal, but not with both.  PayPal can suspend your account if your receive a refund from them and a refund from the credit card.  However, you're past the 45-day time limit, so your only option is a credit card chargeback.

It's too late for this for Dash, but for everyone else, it's important to remember that you have 45 days from the date of payment to open a PayPal dispute, then 20 days to escalate the dispute to a claim.

I rarely offer international shipping on eBay, and only after I make sure the buyer understands that the high cost is what USPS actually charges for the postage plus Registered Mail. 

I'm fairly sure that eBay allows sellers to add the cost of insurance to the postage price or as a handling charge.  I also think it's okay to state in the listing that the postage fee includes insurance, but I'm sure someone will correct me if I'm wrong. Smiley  It just can't be listed as a separate, optional fee.

The seller now keeps on asking me to file the chargeback.  I'm starting to get even more worried since they're acting like I'll never get my money back no matter what I do.  I really need to stop being so paranoid.  Sad

Or maybe it's just reverse psychology?

The seller is being a jerk.  Go ahead and file the chargeback.  The worst that can happen is that the credit card company could deny it, but you'll never have a chance of getting the money back if you don't file.  The seller will place you on his or her blocked list and that'll be the end of it.  Are you still able to view the auction and leave feedback?
