Please let me know your thoughts on this...

I bought a case of cards from a US Ebay seller on 12th August and paid via Paypal. This was a pre-sell.
On the 14th September the listing was cancelled.
The same day, the seller said he would be re-listing.
On the 24th I asked him when the re-listing would take place and would I have to re-bid or would I be credited with the already paid for case?
The re-listing took place on 26th September. I re-bid for my case.

I have now been told by the seller that I have been credited with TWO cases. He has given me some guff about having to pay Ebay fees twice as he has sold two cases. As far as I'm concerned, as the first listing was cancelled and the purchase ceased to exist. Why else would he have told me about the re-listing? He now wants me to complete an Ebay form mutually cancelling the September buy so he doesn't pay fees. I put it to him that the 12th August listing should be the one to cancel. The way I see it, I still get Ebay protection this way.

Something else for you to ponder. He only ever listed 15 boxes in the cancelled and current auction. As there are 10 boxes in a case, how has he credited me with 20 boxes?

I'm confused.  Was the August 12 purchase done directly with the seller or was it an auction win?  Next, did you bid on an auction for the same release, which was cancelled, relisted, and then you won?  Finally, do you want one or two cases?

The 12th August purchase was an Ebay auction win. He had 15 boxes up for "Buy it now" of which I bought 10 which gave me the sealed case. This he confirmed. The listing was then cancelled, and re-listed just over a month later. I re-bid on the same release. At no time did the seller tell me that my first case was still live. I only ever wanted and paid for one case. Why would he tell me about the re-listing? If he only ever had 15 boxes and I had ordered 10, his new listing should have only been 5 boxes. His original auction was cancelled either by himself or Ebay therefore no purchase was made so I can't see how he is being charged Ebay fees for a sale which no longer exists.

I wonder what was going on? Did you receive an email about the listing being cancelled? It's all very peculiar

If it's cancelled by ebay, fees are refunded automatically. 
It makes no sense whatsoever that he would cancel the auction himself when 10 of the 15 boxes had been sold. 
Since the auction was cancelled by someone, I agree that the previous wins are now null and void.  You should only have to pay for the new auction you bid on. 
Is it possible to file a claim for the previous boxes, then pay for the new ones?  Although it would probably end up really making him angry. 
He's violating ebay rules there somehow, so you're totaly in the right.

Oh,wait!!!!  Also, did you get an email from ebay about the cancelled listing saying that you were not responsible for completing the transaction?
I've gotten one of those before when an auction I was bidding on was cancelled by ebay.

Ebay cancelled the auction and they notified me. I think this was because the product was delayed and it had gone past 30 days.

Just an added bit of info for people to ponder - by the time the first auction was cancelled it had been paid for a number of weeks previously.  At no time did the seller contact Boggy about this; the first he knew was when he got the cancellation Email from Ebay so he has no idea who cancelled the auction, Ebay or the seller.  When Boggy contacted the seller he didn't offer a refund but simply kept saying they would be re-listed.  When Boggy asked if he needed to bid again the same answer kept coming back, the product would be re-listed. 

Boggy actually used my Paypal account to pay for this case and to be honest I am a bit loath to put in a claim at this stage.  As I understand it, when you place a claim it costs quite a lot, although maybe I am wrong about this .  The seller is 100% with loads of feedback so there probably is no need to worry, I just wish these big Ebay dealers would realise that us little buyers need some reassurance that there is nothing dodgy going on.   What I just can't understand though is why he wants to use the cancelled auction and not the live one - as Boggy says there is no protection on the cancelled auction (you can't even ask a question through Ebay on it anymore).

I've filed a couple of claims going back about 3 years, and it's never cost me anything.  Then again, both sellers refunded on thier own and didn't wait for ebay to confiscate the $.  From what I recall, you can only file 3 per year.

There is no fee if the buyer and seller are in the US, but I remember reading here a while back that UK members were hit with currency conversion fees when money was refunded from a US seller.
