I just had my film cell listings removed from ebay because they said that Warner Brothers contacted them saying it infringes on their copyrights!! Here is the email from ebay where they tell me my account will be suspended if I try to relist them. I am going to forward this email to artbox with how unhappy I am. Dear ztaylork,

I don't know because there are still many listings on ebay with the same cards??? I just woke up this morning with two emails that puzzled me greatly, and I've got a ton of schoolwork beating me down as well, so I am very frustrated right now.  ztaylork |

If they removed yours, then everyone else;s should be removed too. Are the others listed differently? With different titles? I don't see any reason why you can't sell these.

This should mean that anyone listing filmcards will have their listings removed. I wonder if the listing is the problem, or if it's just the scan? It will be a problem if no one can sell the cards.
This doesn't set a good precedent. Any company could tell eBay to remove a listing because they don't want their images on the site -- DVDs, books, posters, etc.

And the auctions are gone, but my descriptions were no different than most. If you search by that title it brings up a few with the exact same title. I don't know what the deal is.

I hadn't thought of it before but there are issues over film cells and who owns what! I'll get Mark to comment, he'll know - he was a Projectionist at a local cinema through University

Are the Disney film cards listed? The reason I ask is, I used to work for a company that made movie previews for video stores (you know, when you go to a video store to rent a movie, there is always a TV playing previews). Anyway, they had an online preview site too, and apparently thet did a Disney preview. Disney claims they did it without permission and sued them. I only worked at the company for 2 months, but going to their website a few months later, I realized that Disney won this huge lawsuit. As the website stated some bad stuff about what Disney supposidly did to them, and then a cuople months later, the company was bought out by someone else.
I bring this up because Disney does not like people doing this sort of stuff without their permission (this is my opinion, as this is how it seems from what happened). So if their film cards are up, and some HP ones are still there, it almost seems like there might be more to this story.

It's true, if you are flogging film cells AS IS then you are selling something which technically isn't yours. That's because when a cinema finishes with the trailer or the actual film you are required to return them to the film distributor (although with the trailer it will obviously never be used again so what's the point?). Anyway, so if you cut bits out of it to sell I can see why you would get in trouble. But WB obviously gave permission to artbox to use cells from the trailer to do this to - they probably even gave them a bunch of trailers! This is ridiculousness of the highest order. I would do as they say and contact them telling them you think your auctions were ended without justification. I mean seriously, who are they trying to kid? To be honest, I would have thought OUR auctions would have been stopped over any other as we have stolen frames from the actual trailer to illustrate what is in the frames on the card! Idiots!  |

I agree, Artbox got permission to make these and give them to Artbox, which obviously had permission to sell them in their boxes. So why can't you sell them? Won't I see them for sale at a card show too? wouldn't that technically not be allowed?
The thing that doesn't make sense to me is that there are still other auctions up for these. Something is not right.

I am sure Artbox got permission, but please do not say that, as I have not got my boxes yet, and at this rate, I have no clue when they are coming. I wish someone could confirm if Diamond Comics every received their shipment, as they need to get them before shipping to my local store, before I get them!!!!!

I bought some cases from Diamond Collectibles, is that the same as Diamond comics, if so then they do have their cases and your local store should have them today or monday.

I think this is a load of crap. That is not the property of WB anymore as Artbox pays WB to get the license, WB has to license and approve the set, and we buy the product from Artbox. In fact the wrapper has the WB logo on it. Isn't it your property now? It certainly doesn't belong to WB anymore. They have licensed those rights correct? Does anyone know a lawyer? I bet they could answer the question and if they are in the wrong you could take it to court  Of course they would love to tie you up in court til you spent your last dime. But anyways I think you should email nonsportupdate on this issue and ask them to bring it up in their next issue. How many film cell cards have been sold before. What about Disney treasures? I haven't ever heard of Disney pulling this crap. Who is going to buy a film cell card without seeing the cell? |

It just makes me mad, I should have to jump through loops to sell my cards. I don't know if any of you viewed them before they were removed from ebay, but it had a scan of the five cards, you couldn't even really see the film frames and what they were, I had described what was in each film frame in the description. I just don't see why I am being singled out, as I don't think anyone else has had there auctions removed.
