About a month ago I sent some cards to the usa, has yet they have not been received in the mean time I have been in contact with the post office etc, not much can be done has not insured now the buyer has demanded a refund or replacements. This in its self is not a problem has I would of replaced or refunded the items any way, but I just don’t like the attitude that automatically puts the reasonability on the seller for thing going missing in the post (even when have proof of postage), when other cant show proof of delivery. Just letting off stem but would like to hear others thoughts. also would i be unresonable if i asked for posative feedback before issing a refund

This is a very tricky one. Is the item very expensive? I have had a few, very rare cases of items going missing, so it is not beyond the realms of possibility that your buyer is telling the truth.

I don't think your buyer would have any reason to neg you if you sent a refund as long as you have kept in as regular contact as you possibly can, but I don't think they'd be happy to leave you positive feedback before they get their refund.

I know what you mean, the seller loses out if the buyer doesn't purchase insurance ::) it's a crazy old world. I tend to insist on sending anything over £30 insured where possible and I'm sure this puts buyers off, but I'd rather that, than lose an expensive item outright.

Unfortunately for sellers, eBay and PayPal state that it is the seller's responsibility to deliver an item to a buyer.  That's why PayPal requires tracking in order for a seller to qualify for the protection program (such as it is).  I agree with Roz that you can't ask the buyer to leave you feedback as a condition of issuing a refund.  In fact, I think eBay has a policy that if a buyer leaves positive feedback, the buyer loses the right to file any sort of claim about the transaction.
