: Paid for and not received item
: mclarkey January 13, 2005, 09:53:53 PM
Hi
is there anyone out there who can help.  Well I finally saved up enough money to finish my FOTR collection the last card being of course 'MERRY' of which I won as higgest bidder on EBAY.   I paid through paypal over 5 weeks ago to the seller in USA and have still not received the card.
Paypal protection has given me $1000 back but I am still $531 owed and have no other way of raising the money of wich I still have to pay for the card on my visa which I have not even received.  The item was insured but not for the amout I requested.  They traced the item and it could not be found and the seller is now not replying to emails (for past 3 weeks)

Can anyone help as I have no idea what to do next?

Thanks to the price guide I've dug out your auction!

:) I hope you don't mind

The odd thing is how much great feedback the seller has - have they just stopped emailing?

Have you tried ebay themselves for the final $500 because they are supposed to protect you for everything but about $25  :-\

Any ideas guys?

I agree with Roz. Ebay should pay you the 475$ (buyer protection - 25$)

So sent a mail to Ebay. Good Luck  ;)

Have you got his contact information (phone number) through eBay yet?
Or perhaps his email filter is blocking your emails? I sincerely hope he's not the one blocking them ...  :-\
Have you contacted any of his other buyers through eBay to see if they had any problems emailing him?

I don't know how helpful eBay will be if you've already had a refund from PayPal, but I do think you'll have to contact your credit card company as well to see if you can get a refund on the balance from them.

That's horrible to finally win the card which finishes your set and then not receive it! :-[

Good Luck and please let us know how you get on won't you? ;)

I will get back with any updates

Did you get your card yet?

I won a Marauders Map a few weeks ago and it was shipped from the UK to the US on January 7.  I have not yet received it.  However, my seller told me thayt he got two items from the US, one was shipped 12/17 and the other 12/22.  They both just arrived to him today.  I think mail may be held up a bit.  I am praying mine still shows up, as like you, it is a card i really want, just didn't cost as much.  However, it was the most money I ever spent on a card which is why i think I am suddenly so concerned.

Hi, sorry to hear you had trouble also.  The answer to the question is NO.......... Still not received item or had any email from seller.  Paypal did refund me some but not the full amount so if you paid through them that is one option you are covered by up to $1000.  I have contacted ebay and reported the incident and am in the process of having my credit card company look into the matter. It does look now (nearly 7 weeks later) that I have been robbed of my money.  Rest assured if the matter is not sorted the seller will not be dealing with ebay or paypal again.  There is still hope :) :) :) :) :) Leaving negative feedback on ebay is a good option also

I paid for insurance with my card, so if it doesn't come, I will be able to get a refund.  And my seller has been wonderful responding to my email concerns.  I will keep you posted, please do the same.

I would not have hesitated to contact your Credit Card Company as soon as the problem raised its ugly head.  You yourself said that PayPal only covered you up to $1000 and that the card was underinsured.  Why was this and whose decision was that?  Anyway contact with your Credit Card Company would have been your best bet to have the charge taken off.  I had two large purchases I made on ebay and paid via PayPal.  The Sellers were in the U.K. and I never received my items.  I had read many threads on how bad PayPal and ebay were in helping people recover their money so I did not take a chance on them and went directly to my Credit Card Companies - Mastercard and American Express.  The Customer Service Reps had many dealings with both PayPal and ebay and handled my complaints directly with them both and I did not have to do anything.  I received full credit from my Credit Card Companies and did not lose a cent.  I wish you well and hope you recover your money and that the Seller you dealt with gets nailed.

Now why did you have to say that you had two items that never came?  Make me more worried about the one that I am waiting for ;) if you don't mind my asking, what were they?

But seriously now, what if you use PayPal and the funds come out of your checking account?  As I do not have mine set up to go to my credit card.

: savage727 January 28, 2005, 12:18:23 AM
Good question - I do not know the answer to that one as I only pay for auctions with my credit cards.  The items I purchased from the two U.K. Sellers were matted and framed film cells from the 3 LOTR's movies.  I had won 6 auctions for film cells of Aragorn and Gandalf that were beautifully matted , framed and had engraved nameplates.  The total dollar value of the 6 pieces was a bit over $300.00.

If you paid via PayPal with your checking account, the only recourse you have is with PayPal.  The best thing to do, if possible, is resolve the issue with the seller.  You'll get back more money that way than if PayPal becomes involved.

Although, RNS, now that your card is in New Jersey, it's not an issue for you anymore! :D

You are very right!!  Thankfully, the card is on its way according to the tracking number.  I have never been so worried before.

Did you receive your Merry card, or are you still waiting for it to arrive?! :o

: Re:Paid for and not received item
: mclarkey February 07, 2005, 10:29:17 PM
Hi
No Merry card has been received yet, I have entered tracking number into US Postal service tracking site and to my disbelief it came up that the number I entered had not been purchased so therefore the parcel was never sent insurred or sent at all.  The seller has emailed me but since I informed him of this no emails have been received.  I now strongly feel that I have been ripped off and have lost confidence in purchasing items of large sums of money.

My credit card company is sorting it out now and I have been informed that the ebay member in question's paypal and ebay accounts are frozen.

I pray that I get my money back but at the moment, who knows?????????

: Re:Paid for and not received item
: Roz February 07, 2005, 10:35:40 PM
Yep - ebay is a big empty place when it comes to trying to get money back.

The problem is of course that between us (the forum) we don't have a pile of Merry's to share, sell and trade so we have to branch out into the unknown but where possible it just goes to show how important it is to stick to folk we know

 :'(

: Nienna February 08, 2005, 02:33:15 AM
Oh NO!! :o :o :'(

I wish you every success in getting all your money back through your credit card company, but I'm sure you would've preferred the card instead.
I don't know what else to say really, except it's a disgrace and I'm very sad the whole deal turned sour! :(

Please keep us updated how it turns out and whether the credit card company are any help or not.

That card I paid for and hadn't received still hasn't arrived and I very much doubt it will either.
So it looks as though I've lost $60 on mine which is peanuts next to what's at stake with your transaction.

Good Luck! ;)

Well folks heres the latest :'(

Ebay WON'T refund any money as Paypal gave me $1000 which obviously is $531 short of the $1531 origionally paid for the FOTR MERRY AUTO.
Tried to leave NEGATIVE FEEDBACK, but as ebay has thrown WEMISSE off ebay I can't leave any (but at least the user cannot rip any one else off. :-[

My credit card company is investigating and I should hear the final out come soon, but I feel I will not get any money back and still will have lost $531 from an ebay auction site I regarded as highly safe  :-X

I suppose the seller who ripped me off will come on again as a new user using a new identity, so here goes,to ALL EBAY USERS "BE WARNED" >:( >:( >:(

Oh dear .... :-[ :'(
I do hope you manage to get the full amount once they've finished their investigations. :-\

I don't know if you've seen it, but Gimli has a FOTR Merry up for auction at the moment ....

At least you know this seller is as good as his word (and he's in the UK too which has to be a bonus!) ;)

This is why I dont buy off ebay ::). I mean dont get me wrong sometimes they have great cards but...

: Re:Paid for and not received item
: kbmum March 03, 2005, 07:49:17 AM
There are bad sellers on eBay, but the majority of transactions go through with no problems.  I've been a member of eBay since 1997.  I've never not received an item and I've had only one bad buyer.  Of course, I've probably just jinxed myself. ::)

The point is, you shouldn't be afraid to use eBay.  You just need to be cautious, and you can ask here about any seller before bidding.  If someone is going to cheat you, they're going to want as much money as possible. It's certainly easier to cheat one person out of $1,500 than dozens of people for lesser amounts.  Hopefully for mclarkey, the credit card company will come through and get back the rest of the money.

I agree, if it was not for Ebay, I would not even have my collection. Like kbmum said, you just have to be careful and ask for advice. After you have been there for a while, you get to know pretty well when a seller/buyer is dodgy, who is good to buy from etc. Experience is the key :)

: mcgonagall March 03, 2005, 08:58:39 AM
I am like Ferdinand I wouldn't have my collection of cards if it was not for ebay.

It just takes a little time to get used to ebay . I have had items not turn up but it has always been sorted out very quickly.

And as she said you can always ask here about a seller
We are freindly

I have one bad experience I could share..... maybe it will help you out too.

I got the wrong item from a UK seller. I left feedback for the seller and also filed with Square Trade. They helped us through the ordeal. And I got my $$$$$ back and he had my feedback lifted....  but that was the deal. It was a substantial amount too. I did contact the credit card too. I don't see how you can't get your full amount back especially if you paid for insurance. If the seller put a lesser amount for insurance then I would go after the seller. He needs to give you a refund. I would definitely contact the credit card company for fraud..... you have up to 3 months from the date you paid but I wouldnt wait that long.

The seller might have sent it to a friend of his and shows it was mailed out.....  :P

I do hope you get all your money back...  ??? and don't give up pursuing the seller.

Thanks mate.  I no longer expect the card now (since 3 months have passed now).  :o I've left negative feedback and the seller wa staken off ebay  :), BUT now I see he has been reinstated  >:(I HAVE NO IDEA WHY.  May be so he can rip off another person and RUIN their xmas  :'(

My credit card company are still dealing with my case so lets hope I get my money back

Cheers again for sharing your experience mate ;)

What a total bummer!! :-[
That is just SO wrong for him to be re-instated and you left with nothing at all ... completely outrageous! >:(

Nice bit of neg feedback you left for him and I'd say he'd earned every word of it!! ;)
*Fingers crossed* your credit card company refunds your payment asap.

Hi again

Heres the final outcome of the rip off merchant from ebay.  Paypal did manage to refund me $1000.  The ebay seller WEMISSE did not reply to my emails  >:D.  I am still $562 short of the $1562 I origionally paid for the FOTR MERRY AUTO (and yes you've guessed it "still no card").  >:( WEMISSE seams to still be on ebay so ALL BE WARNED  >:(. My credit card company CANNOT get me the money back so that route was a waist of time as it seams the seller does not return emails to PAYPAL or to CREDIT CARD companys.

I'm very angry that this could happen, as to save up for an auto to finish my set took so long and then to go through all the pain and lies to later find there is not really an auto for sale and it was all a SCAM, and the fact that ebay or any one else can do something about it.  And the fact that the seller can still be on ebay makes me really sad.  I suppose the seller WEMISSE is having a good old laugh  And I can just pray that this sort of thing does not happen to anyone else :o=

I don't suppose I will ever finish my set now  :'(

: ferdinand_the_yak May 18, 2005, 06:04:26 PM
If he is still active on Ebay, wouldn't they have a Paypal account that they could retrieve money from? I was in the same situation with a much less expensive card, but same deal - refunded some of the money and Paypal tried to get the rest (but failed as they had closed their account after their scam). I managed to get my seller kicked off Ebay... wonder why they seem so reticent about doing the same for your rip off artist given the amount of money you lost >:()
